Personal Information We Collect or Process

When we use the term “personal information”, we mean information that identifies you or that can reasonably be linked to you, your business, your account, your order, your enquiry, or your project.

Depending on how you interact with PatternPOP, we may collect and process the following categories of personal information.

Contact and Identity Information

Order and Transaction Information

When you buy products directly through our online store, we may collect information relating to your order, including:

Payments are processed through our payment service providers, including Stitch and PayPal. We do not intentionally store your full payment card details on our own systems.

  • estimated floor area;

  • project description;

Artwork, Design and Brand Information

Because PatternPOP offers custom printed flooring and related products, you may provide us with artwork, logos, floorplans, brand assets, design references, photographs, patterns, graphics or other creative materials.

We process this information to understand your project, prepare quotes, create mock-ups, produce custom products and communicate with you about your order or enquiry.

You are responsible for ensuring that you have the necessary rights or permissions to provide any artwork, logos, brand assets or other materials to us.

POPIA Grounds for Processing

We only process personal information where we have a lawful basis to do so under POPIA.

Depending on the situation, we may process your personal information because:

  • processing is necessary to perform a contract with you or to take steps before entering into a contract;

  • processing is necessary to comply with a legal obligation;

  • processing protects a legitimate interest of you, PatternPOP or a third party;

  • processing is necessary for the proper performance of a public law duty, where applicable; or

  • another lawful basis under POPIA applies.

For example, we process order information to fulfil your purchase, quote information to respond to your enquiry, accounting records to comply with tax and business obligations, and website analytics to improve our website and services.

Marketing Communications

We may use your personal information to send you marketing communications about PatternPOP products, services, offers, promotions, design ideas, product updates and related content.

We will only send you electronic direct marketing where we are allowed to do so under POPIA. This may include where:

  • you have subscribed to our newsletter or otherwise consented to receive marketing from us;

  • you are an existing customer and we are marketing our own similar products or services to you; or

  • another lawful basis under POPIA applies.

Where you buy from us, we may use your email address to send you marketing about our own similar products or services, provided that you were given a reasonable opportunity to object when your details were collected and you are given a clear opportunity to opt out in each marketing communication.

We use Shopify Email to send email marketing communications. Our marketing emails include an unsubscribe link that allows you to opt out of future marketing emails at any time.

Submitting an enquiry, requesting a quote, or communicating with us about a project does not automatically subscribe you to marketing communications unless you separately opt in.

We may also use WhatsApp for customer communication, project discussions and order-related updates.

We will only use WhatsApp for direct marketing where you have consented to receive marketing messages from us by WhatsApp, or where we are otherwise permitted to do so under applicable law. You may opt out of WhatsApp marketing at any time by replying “STOP” or by contacting us.

We may still send you non-marketing communications where necessary, such as order confirmations, quote responses, project updates, delivery information, payment notices, customer service messages, or legally required communications.

  • freelancers, designers, production partners, supplier partners, installers or service providers who help us with design, production, fulfilment, installation, customer service, website support, marketing or related business activities;

  • professional advisers, including accountants, legal advisers or consultants, where necessary;

  • regulators, public authorities, law enforcement bodies or other third parties where we are required or permitted to do so by law; and

  • any other third party where you have directed us to share the information or where sharing is necessary to fulfil your request.

Where service providers, freelancers, suppliers or partners process personal information on our behalf, we expect them to process that information only for the purposes we authorise, to keep it confidential, and to apply appropriate security measures.

We do not sell personal information.

Relationship With Shopify

Our online store is powered by Shopify. Shopify provides the ecommerce platform that allows us to sell products and operate our online store.

When you use our website or online store, personal information may be collected and processed by Shopify so that the store can function, orders can be processed, payments can be supported, and ecommerce services can be provided.

Shopify may process personal information in accordance with its own privacy notices, terms and legal obligations.

International Transfers

PatternPOP is operated from South Africa.

We do not intentionally share personal information with overseas freelancers or human suppliers unless this is necessary for a specific project, service or lawful business purpose.

However, some of the technology platforms and service providers we use may store, process or access personal information outside South Africa. These may include ecommerce platforms, payment providers, analytics tools, advertising platforms, cloud services, email systems, accounting systems and other business software providers.

Where we transfer personal information outside South Africa, or where our service providers process personal information outside South Africa, we will take reasonable steps to ensure that the transfer is lawful under POPIA.

This may include relying on appropriate data protection laws, binding agreements, service provider terms, contractual safeguards, your consent, contractual necessity, or another lawful basis for the transfer.

By using our website, online store, enquiry forms or services, you understand that your personal information may be processed by service providers in countries outside South Africa where this is necessary to provide our website, process payments, fulfil orders, provide customer support, measure website performance, run advertising, or operate our business.

Retention of Personal Information

We will only keep personal information for as long as reasonably necessary for the purposes for which it was collected or processed, unless we are required or permitted to keep it for longer under applicable law, contract, consent, or for a lawful business purpose.

As a general guide:

  • we keep customer order, transaction, payment, delivery and invoice records for at least 5 years, or for longer where required for tax, accounting, legal, warranty, dispute or business record purposes;

  • we keep quote, enquiry and customer communication records for at least 5 years, because customers may return to a previous enquiry, quote or project discussion and because we may need these records for business, legal or dispute-resolution purposes;

  • we keep customer artwork, logos, floorplans, design references and project files for at least 2 years after the project is completed or last active, because customers may return for repeat orders, replacements, matching work, updated designs or related projects;

  • we keep newsletter and marketing subscription records for as long as you remain subscribed, and we may keep limited suppression records after you unsubscribe to ensure that we do not send you further marketing communications; and

  • we may keep records for longer where this is required or permitted by law, where reasonably necessary to protect our rights, resolve disputes, comply with obligations, enforce agreements, or maintain accurate business records.

If we no longer need personal information and are no longer legally permitted or required to keep it, we will take reasonable steps to delete, destroy or de-identify it.

You may request that we delete artwork, logos, floorplans, design references or project files linked to your project. We will consider and respond to such requests in accordance with POPIA, subject to any legal, contractual, operational, accounting, dispute-resolution, warranty or legitimate business reasons that may require us to keep certain records.

Security of Personal Information

We take reasonable technical and organisational measures to protect personal information against loss, damage, unauthorised access, unlawful processing, disclosure, alteration or destruction.

Customer and project information is generally stored and managed through systems such as Shopify, Google Workspace, Wave, Zoho and WhatsApp Business, as well as related business systems used for quotes, invoices, communication, fulfilment and customer service.

Access to customer information is limited to Roche Potgieter and to service providers, suppliers, freelancers, production partners, courier providers or other trusted third parties where access is necessary for a specific business purpose, such as preparing a quote, producing an order, delivering a product, providing customer support, performing design work, or supporting our website and business systems.

Where we work with service providers, suppliers, freelancers or partners who may access personal information, artwork, logos, project information or customer details, we expect them to keep that information confidential, use it only for the authorised purpose, and apply appropriate security measures.

Although we take reasonable steps to protect personal information, no method of transmission over the internet or method of electronic storage is completely secure. We therefore cannot guarantee absolute security.

If we become aware of a security compromise involving personal information, we will take reasonable steps to investigate, contain and remediate the incident. Where required by POPIA, we will notify the Information Regulator and affected data subjects as soon as reasonably possible.

Your Rights Under POPIA

Subject to POPIA and other applicable laws, you may have the right to:

  • ask whether we hold personal information about you;

  • request access to personal information that we hold about you;

  • request correction of inaccurate, irrelevant, excessive, out-of-date, incomplete or misleading personal information;

  • request deletion or destruction of personal information that we are no longer authorised to keep;

  • object to certain processing of your personal information;

  • withdraw consent where we rely on consent to process your personal information;

  • opt out of direct marketing communications;

  • complain to us about how we process your personal information; and

  • lodge a complaint with the Information Regulator.

We may need to verify your identity before responding to a request. This is to protect your personal information and to ensure that we do not disclose, correct or delete information in response to an unauthorised request.

We will respond to requests within a reasonable time and in accordance with POPIA.

Some rights are not absolute. We may refuse or limit a request where POPIA or another law allows or requires us to do so, for example where we need to keep records for legal, tax, accounting, contractual, warranty, dispute-resolution or legitimate business purposes.

Opting Out of Marketing

You may unsubscribe from email marketing at any time by using the unsubscribe link in our marketing emails.

You may opt out of WhatsApp marketing by replying “STOP” or by emailing us at roche@patternpop.co.za.

Even if you opt out of marketing, we may still send you non-marketing communications, such as order confirmations, quote responses, project updates, payment notices, delivery information, customer service messages or legally required communications.

Children’s Personal Information

Our website, online store and services are not intended for children.

We do not knowingly collect personal information from children without the consent of a parent or legal guardian.
